The Islamabad court on Thursday acquitted Lieutenant General (retired) Amjad Shoaib in a case related to incitement against state institutions.
Additional Sessions Judge Tahir Abbas Sipra announced the verdict reserved earlier in the day after hearing arguments from prosecution and defence lawyers.
The former army officer was produced before the court following the completion of his three-day physical remand.
During today's hearing, Amjad Shoaib’s lawyer argued that the case lodged against his client did not fall under Section 505.
Amjad Shoaib’s lawyer said that his client expressed those remarks on the talk show discussing an election-related topic. In its recent verdict, the Supreme Court mandated that elections be held in Punjab and Khyber Pakhtunkhwa within 90 days. He said that if the decision had been made sooner, the talk show would not have taken place as he begged the court to dismiss the charges against his client. The prosecutor, though, had objected to it.
While announcing the verdict, the court ordered the release of the former army officer in the case.
On Monday, the court approved the three-day physical remand of Lieutenant General (retd) Amjad Shoaib, who had been arrested on charges of inciting the public against national institutions.
Lieutenant General (retd) Amjad Shoaib was presented in court today after he was arrested by the Islamabad police early in the morning.
The Islamabad police presented the former army officer before Judicial Magistrate Abbas Shah. During the hearing, Prosecutor Adnan told the court that the former military officer, through his statement on TV, tried to spread hate between the government, the opposition, and the government employees.
The lawyer also informed the court that they needed to take Amjad Shoaib to Lahore for a photogrammetric test. The lawyer pleaded with the court to grant Lt Gen (retired) Amjad Shoaib a seven-day physical remand.
Meanwhile, Lt Gen (retired) Amjad Shoaib’s lawyer opposed the physical remand plea and urged the court to dismiss the case. The lawyer stated that the sections added to the case do not apply to his client.
The lawyer told the court that the case against his client was registered on the basis of political rivalry. “If constructive criticism is difficult to absorb, then remove all opposition from the system,” the lawyer advised.
