Islamabad High Court Stops Construction Of Wall Around Defence Complex

The Islamabad High Court (IHC) has ordered a halt to construction of a wall around the Margalla Hills national park for constructing the Defence Complex.

in Rawalpindi, directing the authorities concerned to act against those carrying out an illegal activity or construction on state land.

The court issued the ruling during hearing of a petition filed by a villager who was affected by the construction. IHC Chief Justice Athar Minallah also ordered the CDA to make sure that the construction of the Defence Complex is done as per the plan earlier approved.

The petition was filed by a resident of Bairi Meera village, which is under the jurisdiction of the notified area of the Margalla Hills National Park. He had sought action against what he termed illegal encroachment of the Quarter Master General (QMG) on the land around the Defence Complex in Sector E-10.

A specified area was given by the CDA under the Capital Deve­lopment Authority Ordinance, 1960 to set up the Defence Complex in Sector E-10.

In its petition, the complainant also attached photos to prove that the QMG illegally encroached upon an area of the national park by initiating construction of a wall. He maintained that the wall is situated outside the area reserved for the complex.

The IHC noted that in two of the identical petitions, the Supreme Court had clearly stated that no illegal activity or construction should take place within the notified areas of the national park.
